Terms of service

Definitions

 

  1. "Buyer" means the purchaser of HairMax products and other products from the Seller via this Website.

  2. "Seller" means HairMax (Thailand) Co., Ltd., the official distributor of HairMax products in Thailand.

  3. "Products/Goods" means HairMax products and other services sold by the Seller on this Website.

  4. "Website" means the website hairmaxthailand.com.


 

General Agreement

 

This agreement is considered a sales contract between the Buyer and the Seller. If there are any details regarding the agreement for the purchase and sale of products under the HairMax trademark that differ from this agreement, the details specified in this agreement shall prevail, unless the Buyer and Seller agree otherwise in writing on a case-by-case basis.


 

Payment

 

  1. If the Buyer mistakenly transfers money to an account other than the one specified by the Website, it is the Buyer's sole responsibility to follow up and claim the funds.

  2. If the Buyer pays less than the full amount, the Website reserves the right to confiscate the money without shipping the Products, or to adjust the order status to wait for additional payment, or to ship fewer Products, where the value of those Products is less than or equal to the amount paid. However, if the Buyer contacts the Website to amend the order to match the amount paid, the Website is willing to make the necessary corrections.

  3. In the case of underpayment, if the Buyer contacts the Website to make an additional payment within 3 days after the Website notifies them of the incomplete payment, the Website is willing to accept the additional payment without extra charges or canceling the order, and will ship the Products within 1 business day after receiving the full payment.

  4. Payment is complete when the Website receives the payment notification from the customer and has verified that the payment for the Products has been successfully processed into the system. This applies to payment channels via bank (counter transfer, online transfer, or ATM payment) or credit card system. The customer can submit a payment notification through the Seller's telephone, email, Line, or Facebook channels specified above.


 

Product Delivery

 

  1. All ordered Products from the Website receive free shipping within Thailand only.

  2. Products will be sent to the Buyer only after the Buyer has paid for the Products and the Website has verified the payment.

  3. The Seller's standard practice is to ship the Products with the shipping service provider (Kerry or Thailand Post) within 24 hours of the business day after the payment verification is completed, and the tracking number will be provided to the Buyer.

  4. Products will be shipped to the delivery address specified by the Buyer during the Checkout process. The Products will reach the Buyer within 2-3 business days, unless the Seller notifies otherwise.

  5. The Seller will not be responsible for any delays and/or damages from shipping due to the fault of the shipping service provider, which is beyond the Seller's control. However, the Seller will cooperate fully in following up with the shipping service provider.

  6. If the Products delivered to the Buyer are damaged due to shipping, it is the responsibility of the shipping service provider to compensate for the damage, and it is the Buyer's duty to claim the compensation from the shipping service provider. The Seller will fully cooperate in the process.

  7. In the case of high-value Products, if the Buyer wishes for the Website to arrange shipping with additional parcel insurance, the extra cost is the Buyer's responsibility to pay the Seller. The Buyer must notify their intention to add parcel insurance before making the payment by specifying it in the remarks field during the ordering process for convenience and speed.

  8. Standard parcel insurance is 2,000 Baht per parcel for both Kerry and Thailand Post shipping companies. Both companies allow the purchase of additional shipping insurance up to a coverage limit of 50,000 Baht.

  9. If the Products received by the Buyer are damaged or imperfect, and it can be proven that the issue arose from the manufacturing process, the Seller is willing to exchange the Products for a new one upon receiving the damaged Products back along with the delivery note, receipt, or cash bill. The Buyer must inform the Seller of the problem through various contact channels within 48 hours of receiving the Products. After 48 hours, the acceptance of the Products and the inspection of their condition shall be deemed complete.

  10. Products that have been shipped out from the Website's system and are currently in transit cannot be refunded or cancelled in any case. Please ensure the information is correct before placing an order. The Buyer may seek advice and consultation from the Seller through the available channels.


 

Force Majeure

 

The Seller reserves the right to not be held responsible for events of force majeure, such as delays in Product delivery due to protests, riots, civil war, terrorism, war, or natural disasters. Under such force majeure events, the Seller may not be able to fulfill some or all of the conditions in this agreement within the specified timeframe. However, the Seller will endeavor to manage the distribution and transportation of Products as normally as possible, as quickly as possible, under the circumstances of the force majeure event.


 

Title to Products

 

The title to the Products shall remain with the Seller until the Buyer has paid for the Products completely and in full.


 

Warranty

 

  1. Products in the laser device category under the HairMax trademark are covered by a domestic warranty for a period of 24 months from the date the Buyer purchased the Products. If the Products are damaged, defective, broken, or have problems arising from use under normal conditions, the Seller is willing to repair, service, maintain, or replace them as appropriate for the specific issue, at no charge.

  2. If the 24-month warranty period has expired, the Buyer can still request repair services. There will be an additional repair fee. The Seller will inform the Buyer of the repair costs and require the Buyer's confirmation before commencing any repair work.

  3. In case of Product problems, the Buyer can contact the Seller to request warranty service through the channels specified above. The Buyer is responsible for the shipping cost of returning the Products to the Seller for exchange or repair.

Limitation of Liability

 

  1. The Buyer should read the "How to Order Products" section to understand how to use the service through the website. If the customer makes a mistake due to carelessness, for any reason whatsoever, such as duplicate ordering, selecting the wrong item, not specifying the free gift (during a promotional period), or incorrect payment, these are factors beyond the Seller's control. Therefore, the Seller cannot be held responsible for any part of this. The Website reserves the right to change or return the Products at its discretion and based on the appropriateness of each case.

  2. The Buyer must ensure that the ordered Products are suitable for use and appropriate for themselves or the recipient. Information can be checked from the product details described on the Website or by inquiring with the Seller through other specified contact channels.

  3. The Buyer has no right to claim compensation for any physical or psychological damage resulting from the use of the products purchased from the Seller. This is because the Seller has provided complete advice, warnings, or prohibitions in the product information for those Products, both on the Website and in the user manual.


 

Privacy Policy

 

The Website will not disclose any part of the user's information to a third party, nor will it forward or sell the personal information of the service users to others. The cookies and customer data recording in the system are solely for the benefit of tracking Products/parcels, logging in, analyzing, system development, or for the Website's business operations only. For more details, please read further under the "Privacy Policy" section.


 

Governing Law

 

This Terms of Use agreement and its interpretation shall be governed by the laws of the Kingdom of Thailand. In the event of any dispute arising under this agreement, the parties agree to submit the dispute to the Electronic Commerce Division, Department of Business Development, Ministry of Commerce, for mediation. If mediation cannot be achieved, the dispute shall be submitted to a neutral arbitrator or arbitration institution for a binding decision on both parties.
